Final Arguments in the Human Rights Case

Join us on October 30th 9:30AM at Best Western Plus Chocolate Lake for the final arguments in the precedent-setting human rights case regarding institutionalization and insufficient capacity in community-based supports and services for persons with disabilities.

In 2014 a human rights claim was filed in Nova Scotia, seeking to rectify decades of discriminatory treatment by the Province against people with disabilities. After 29 days of evidence and 35 witnesses, on October 30th Walter Thompson Q.C. sitting as the NS Human Rights Board of Inquiry will hear final arguments concerning the alleged violation from lawyers for the four human rights claimants, the Province of Nova Scotia, and the Human Rights Commission.

Witnesses included people with lived experience of institutionalization, family members of people impacted by the limited funding provided for the Province’s Disability Support Program, advocates for community living, medical experts, Department of Community Services employees, and experts in the provision of supports and services for persons with disabilities. Throughout the hearing, lawyers for the Disability Rights Coalition and the individual complainants have argued that the exclusion of persons with disabilities from mainstream society is discriminatory and in violation of the Human Rights Act.

The closing arguments are the culmination of all the evidence presented and the legal briefs submitted by the lawyers involved. The hearing is open to everyone. The hearing room is on the third floor and is accessible by elevator. Members of the public are welcome to attend to emphasize how important this precedent-setting case is to those people directly impacted by the crisis in supports and their loved ones who are also impacted.
